Terms of service

The deal, in plain words.

These terms cover the MELAN app on Android, MELAN on iPhone at app.melan.app, and this website. By using MELAN you agree to them. We've kept them short and written them to be read.

Who we are

MELAN is run by Oluwadarasimi Oluwagbemiga Adeleye, in Nigeria ("MELAN", "we", "us"). You can reach us at melan.app.help@gmail.com.

What MELAN is

MELAN is a cosmetic skin wellness app. It scans your skin from a photo and gives you readings, a routine, product checks and answers from SIMI, MELAN's AI guide. It was built starting with melanin-rich skin, and is honest for every tone.

MELAN is not a medical device and does not give medical advice. It doesn't diagnose, treat or prevent any condition. Readings are estimates from a photo and can be wrong. If something on your skin worries you, is painful, spreading or changing, see a doctor or dermatologist. When MELAN sees something that may need a professional, it says so.

Who can use it

MELAN is for people aged 13 and over. If you're under 18, a parent or guardian needs to know you're using MELAN and be OK with it, and only an adult can buy a subscription.

Your account

You can try MELAN without an account. To keep your scans you make one, with email and a password or with Google. Keep your password to yourself; you're responsible for what happens under your account. You can delete your account and everything in it at any time from You›Privacy & Data. How we handle your data is in our privacy policy.

Plans and payment

MELAN has a free plan and a paid plan, MELAN Pro, billed monthly or yearly. What each includes and what it costs is on our pricing page. Prices include or add tax as required where you live, and you always see the final price before you pay.

  • On iPhone and the web (app.melan.app): payments are processed by Paystack, which keeps your card details; we never see them. Prices there are in naira.
  • On Android: you subscribe through Google Play, which takes the payment, and Google Play's terms apply to it.

MELAN never sees or stores your card details.

Renewal and cancelling

Pro renews automatically at the end of each month or year, at the price you agreed to, until you cancel. If a price ever changes, we'll tell you before it applies to you, and you can cancel before it does.

You can cancel at any time. You keep Pro until the end of the period you've paid for, then the account goes back to free; your scans and history stay.

  • Paid on iPhone or the web: use the manage-subscription link in the email Paystack sent when you subscribed, or write to us and we'll cancel it for you.
  • Paid on Android: cancel in Google Play, under Payments & subscriptions.

Free Pro days

A new account gets 5 days of Pro, free. No card is asked for and nothing is charged; when the days end, the account simply goes back to free unless you choose to subscribe.

Refunds

If Pro isn't for you, you can have your money back within 14 days of any payment. The details are on our refund policy.

Using MELAN fairly

Please don't:

  • scan someone else's face without their permission;
  • try to break, overload, copy, scrape or reverse-engineer MELAN, or get around its limits;
  • use MELAN for anything unlawful, or to harass or harm anyone;
  • resell MELAN or what it produces as your own service.

We may suspend or close an account that does these things. If we do, and you've paid for time you can no longer use, we'll refund it.

What's yours and what's ours

Your photos, answers and scores are yours. You give us permission to process them only to run MELAN for you, as the privacy policy describes; scan photos are never stored. MELAN itself, including its design, SIMI, its text and its software, belongs to us, and these terms don't give you any rights in it beyond using the app.

Changes to MELAN and these terms

MELAN will change as we improve it: features may be added, changed or retired. If we change these terms in a way that matters, we'll update the date at the top and, where it affects a subscription you have, tell you before it applies. If you don't agree with a change, you can cancel and delete your account.

Our responsibility

We work hard to keep MELAN accurate and available, but it's provided as it is, and we can't promise it will always be uninterrupted or error-free, or that any routine or product will suit your skin. Patch-test new products, and stop using anything that irritates your skin.

As far as the law allows, we're not liable for indirect or unforeseeable losses, and our total liability to you is limited to what you paid us in the 12 months before the claim. Nothing in these terms limits rights you have as a consumer that the law says can't be limited.

The law that applies

These terms are governed by the laws of Nigeria. If you live somewhere whose consumer law gives you more protection, you keep it. If there's a problem, write to us first; most things are sorted out in one email.
